By accessing or using KindredAccess ("we," "us," "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our platform.

2. Eligibility & Age Requirements

You must be at least 18 years old to use KindredAccess. By creating an account, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into these Terms
• Your use of the platform will not violate any applicable law or regulation
• All information you provide is accurate and truthful

3. Account Registration

3.1 Account Creation

To use KindredAccess, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

3.2 Account Suspension

We reserve the right to suspend or terminate your account if:

• You violate these Terms
• You provide false information
• Your account is used for illegal activities
• Your behavior threatens the safety of other users

4. User Conduct

4.1 Acceptable Use

You agree to use KindredAccess only for lawful purposes. You will not:

• Harass, abuse, or harm other users
• Impersonate any person or entity
• Post false, misleading, or defamatory content
• Spam or send unsolicited messages
• Use the platform for commercial purposes without permission
• Attempt to access other users' accounts
• Interfere with the platform's operation
• Scrape or collect user data without permission

4.2 Content Standards

All content you post must:

• Be respectful and appropriate
• Not contain hate speech or discriminatory language
• Not contain explicit sexual content
• Not promote violence or illegal activities
• Respect others' intellectual property rights

4.3 Strictly Prohibited Content

The following content is strictly prohibited and will result in immediate account termination and potential reporting to law enforcement:

• Child Sexual Abuse Material (CSAM): Any sexual content involving minors is illegal and will be reported to authorities including NCMEC
• Non-Consensual Intimate Images: Sharing intimate images of others without their consent ("revenge porn")
• Sexual Exploitation: Content promoting prostitution, sex trafficking, or sexual exploitation
• Pornographic Content: Explicit sexual imagery or videos
• Extreme Violence: Graphic depictions of violence, gore, or torture
• Terrorism & Violent Extremism: Content promoting terrorist organizations or violent extremist ideologies
• Self-Harm Promotion: Content that encourages suicide or self-injury

5. Safety, Moderation & Reporting

5.1 Our Commitment to Safety

KindredAccess is committed to maintaining a safe environment. We employ both automated systems and human review to identify and remove content that violates these Terms.

5.2 Reporting Violations

If you encounter content or behavior that violates these Terms:

• Use the Report button on any profile, message, or content
• Email safety@kindredaccess.com for urgent safety concerns
• All reports are confidential; the reported user will not know who reported them

5.3 Moderation Process

When we receive a report:

• Urgent reports (harassment, threats, CSAM): Reviewed within 24 hours
• Standard reports: Reviewed within 72 hours
• We may take action including content removal, warnings, temporary suspension, or permanent ban
• Illegal content will be reported to appropriate law enforcement

5.4 User Safety Tools

You have access to these safety features:

• Block: Prevent a user from viewing your profile or contacting you
• Report: Flag concerning behavior for our review
• Unmatch: End a connection and remove chat history

6. Profile Information

6.1 Accuracy

You agree that all profile information, including personal circumstances, accessibility needs, and preferences, is accurate and honest. Misrepresentation may result in account suspension.

6.2 Photo Requirements

Profile photos must:

• Clearly show your face
• Be appropriate (no nudity, violence, or offensive content)
• Be of you (not celebrities, children, or other people)
• Not contain watermarks or promotional content

6.3 Photo Moderation

All uploaded photos are subject to moderation. Photos that violate our content standards will be removed. We may use a combination of automated and human review to moderate photos.

7. Privacy and Data

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information.

8. Intellectual Property

8.1 Our Rights

KindredAccess and its content (excluding user-generated content) are protected by copyright, trademark, and other intellectual property laws.

8.2 User Content

You retain ownership of content you post, but by posting, you grant us a license to:

• Display your content on the platform
• Use it to improve our services
• Share it as necessary to provide our services

9. Disclaimers

KindredAccess is provided "as is" and "as available." We make no warranties about:

• The accuracy or reliability of user-provided information
• The success of connections made through the platform
• Uninterrupted or error-free service
• The behavior of other users

10. Limitation of Liability

To the fullest extent permitted by law, KindredAccess and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by email or through the platform. Your continued use after changes constitutes acceptance of the new Terms.

12. Termination

You may delete your account at any time through your settings. We may terminate or suspend your account for violations of these Terms. Upon termination, your right to use the platform ceases immediately.

13. Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

13.1 Dispute Resolution

If you have a dispute with KindredAccess:

• Step 1 - Contact Us: First, contact us at legal@kindredaccess.com to try to resolve the issue informally
• Step 2 - Mediation: If informal resolution fails, we agree to attempt mediation before litigation
• Step 3 - Small Claims or Court: Either party may bring claims in small claims court (if eligible) or in state/federal courts in Delaware

13.2 Class Action Waiver

To the extent permitted by law, you agree that any dispute resolution will be conducted only on an individual basis and not in a class, consolidated, or representative action. If this waiver is found unenforceable, then the entirety of this arbitration/dispute resolution provision shall be null and void.
